These Terms of Use (“Terms”) govern your access to and use of the indicators, scripts, strategies, educational materials, software, and other products or services (collectively, the “Products”) provided by MangosteenBTC (“Provider”, “we”, “us”, or “our”). By purchasing, installing, accessing, or using the Products, you (“you”, “User”) agree to be bound by these Terms. If you do not agree, you must not access or use the Products.

1. Definitions

1.1 “Content” means all materials, data, code, indicators, algorithms, documentation, videos, and other information made available by us.

1.2 “Licence” means the limited rights granted under clause 4.

1.3 “Third-Party Services” means external platforms, APIs, or software not operated by us (including, but not limited to, TradingView, YouTube, and payment gateways).

1.4 “User Content” means any content, feedback, or information submitted by you to us.

1.5 “Effective Date” means the date on which you first accept these Terms or access the Products.

2. Educational Use & No Financial Advice

2.1 All Products are provided strictly for informational and educational purposes.

2.2 We do not hold an Australian Financial Services Licence (AFSL) and do not provide financial, investment, tax, or legal advice.

2.3 The Products are not tailored to your personal objectives, financial situation, or needs. You remain solely responsible for your own investment decisions.

2.5 The Products are designed to demonstrate market analysis concepts and trading education, not to predict or advise on financial outcomes.

2.6 Any examples or case studies are purely illustrative.

2.7 You should obtain your own independent advice from a licensed financial adviser before making investment decisions.

3. General and Informational Use Only

3.1 The Products and all related content are provided for general informational and educational purposes only.

3.2 They do not constitute financial product advice, investment advice, or a recommendation to acquire or dispose of any financial product under the Corporations Act 2001 (Cth).

3.3 You should obtain your own independent advice from a licensed financial adviser before making any investment decisions.

3.4 By using the Products, you acknowledge that all information is of a general nature and is not intended to influence your personal investment objectives, financial situation, or needs.

4. License Grant & Disclosure

4.1 Subject to payment of applicable fees, we grant you a personal, non-exclusive, non-transferable licence to use the Products for your own educational, analytical, and research purposes.

4.2 The Products are not designed or intended for live-trading execution or automated trading systems, and we provide no assurance regarding their accuracy or suitability for such purposes.

4.3 You must not, without prior written consent:

    (a) copy, reproduce, resell, sublicense, or redistribute the Products;

    (b) modify, adapt, translate, or create derivative works from any Product;

    (c) reverse engineer, decompile, disassemble, or attempt to derive source code or logic;

    (d) share access, credentials, or outputs with others;

    (e) use the Products for unlawful, misleading, or deceptive conduct; or

    (f) remove or obscure any copyright, trademark, or proprietary notice.

4.4 We reserve the right to suspend or terminate your licence immediately for any breach of this clause.

5. Ownership and Intellectual Property

5.1 All intellectual-property rights in the Products and all associated materials—including source code, compiled code, algorithms, trade secrets, brand elements, and documentation—are and remain the exclusive property of MangosteenBTC.

5.2 You acquire no ownership or intellectual-property rights other than the limited licence expressly granted.

5.3 You acknowledge that the Products are protected by international treaties, including the Berne Convention and WIPO Copyright Treaty.

6. Updates, Modifications and deprecation

6.1 We may update, improve, or discontinue any Product at any time without prior notice.

6.2 Updates are provided to enhance user learning experience and platform compatibility only, not to improve financial performance or trading accuracy.

6.3 We are not liable for any impact caused by changes in third-party platforms (e.g. TradingView) that affect compatibility or availability.

6.4 If a Product is withdrawn within three (3) months of your purchase, you may request a full refund under clause 9.

7. Confidentiality and Non-disclosure

7.1 All Product logic, scripts, code, and internal documentation constitute confidential information.

7.2 You must not disclose, distribute, or make available any such confidential information to any third party.

7.3 This obligation survives termination of your licence.

8. Account Responsibility

You are responsible for maintaining the confidentiality of any login credentials and for all activity under your account.

We are not liable for any loss resulting from unauthorised access to your account where caused by your failure to protect credentials.

9. Refunds & Consumer Rights

9.1 We offer a 14-day refund on first-time purchases.

9.2 Refunds must be requested within 14 days of purchase by contacting info@mangosteen.global.

9.3 This policy does not limit your rights under the Australian Consumer Law (ACL), which may entitle you to remedies for defective digital goods.

9.4 Refunds are not available for breaches of these Terms or misuse of the Products.

9.5 Refunds are not linked to trading results, financial outcomes, or the accuracy of any analysis produced by the Products.

10. Limitation of Liability

10.1 To the fullest extent permitted by law, MangosteenBTC and its officers, employees, and agents are not liable for any:

    (a) indirect, incidental, or consequential loss;

    (b) loss of profits, goodwill, opportunity, or data; or

    (c) any amount exceeding the total fees paid by you for the Product in the 12 months preceding the claim.

10.2 You acknowledge that you do not rely on any information or representation contained in the Products as the basis for any investment decision.

10.3 Where liability cannot lawfully be excluded, our total liability is limited to re-supplying the Product or refunding the amount paid.

11. Indemnity

You agree to indemnify and hold harmless MangosteenBTC, its officers, and employees against any loss, cost, or expense (including reasonable legal fees) arising from:

    (a) your breach of these Terms;

    (b) your misuse of the Products; or

    (c) your violation of any law or third-party right.

12. Termination and Suspension

12.1 We may suspend or terminate your access immediately if you:

    (a) breach these Terms;

    (b) misuse or attempt to copy or redistribute any Product; or

    (c) engage in conduct likely to damage our reputation.

12.2 Upon termination, your licence automatically ends, and you must delete or destroy all copies of the Products.

12.3 Termination does not affect accrued rights or obligations.

13. Global Intellectual Property Enforcement

13.1 Unauthorised copying, sharing, resale, or publication of any Product constitutes infringement under international copyright law.

13.2 We actively enforce our rights globally through the Digital Millennium Copyright Act (17 U.S.C. §512), the Copyright Act 1968 (Cth), and other applicable legislation.

13.3 We may seek immediate injunctive relief and damages in any competent jurisdiction to prevent further misuse.

13.4 You agree to cooperate fully with any investigation or audit relating to suspected IP infringement.

14. Third-Party Dependencies

14.1 The Products may rely on Third-Party Services such as TradingView, data feeds, or payment processors.

14.2 We are not responsible for interruptions or failures caused by such third-party providers.

14.3 Your use of those services is subject to their own terms and conditions.

14.4 Our Products may integrate visually or functionally with third-party charting platforms for educational display only. We do not execute or facilitate trades on any platform.

15. Force Majeure

Neither party is liable for any delay or failure to perform caused by events beyond reasonable control, including but not limited to acts of God, cyberattacks, system outages, or regulatory actions.

16. Governing Law and Dispute Resolution

16.1 These Terms are governed by the laws of New South Wales, Australia.

16.2 Parties must first attempt good-faith negotiation, then mediation (e.g. Resolution Institute), before commencing legal action.

16.3 Each party submits to the non-exclusive jurisdiction of the courts of New South Wales and waives any objection based on inconvenient forum.

16.4 We may seek injunctive relief in any jurisdiction where infringement occurs.

16.5 Nothing in these Terms shall be construed as creating a financial services relationship or any obligation under Chapter 7 of the Corporations Act 2001 (Cth).

17. Amendments

We may amend these Terms at any time by posting an updated version on our website.

Material changes will take effect 30 days after posting.

Continued use after that date constitutes acceptance of the revised Terms.

18. Entire Agreement, Severability, and Waiver

18.1 These Terms constitute the entire agreement between you and MangosteenBTC.

18.2 If any provision is held invalid, the remaining provisions remain in force.

18.3 No failure or delay by either party to enforce any right shall be deemed a waiver of that right.
